Fish Deeper Premium Access Terms and Conditions

1. INTRODUCTION

These Fish Deeper Premium Access (12 Months) Terms & Conditions (“12-month Premium access terms”) govern your use of Fish Deeper Premium Access (12 Months) (“12-month Premium access”) on the Fish Deeper Website at: https://maps.fishdeeper.com/en-ww (“Website”). Your use of 12-month access and the Fish Deeper services via the Website also subject to DEEPER - TERMS AND CONDITIONS (“Terms”) available at: https://deepersonar.com/global/all/terms-and-conditions; if you see an undefined term in these 12-month Premium access terms, it has the same definition as in the Terms. These 12-month Premium access terms shall be read and interpreted together with the Terms.

2. FISH DEEPER PREMIUM ACCESS (12 MONTHS)

12-month Premium access is a code comprising of sequence of digits that you can purchase, share, give as a gift and which can be redeemed by you or by someone that you have shared the code with. 

You must have a Fish Deeper account to claim and redeem the 12-month Premium access.

The balance of the 12-month Premium access is equal to the price of annual subscription of Fish Deeper Depth Maps (Premium service) („Fish Deeper Premium“) and you can exchange it only for an annual subscription of Fish Deeper Premium on the Website.  

12-month Premium access is valid for a period of 12 months from the date of purchase. Hence you will not be able to redeem it after the expiry date.

12-month Premium access can be refunded within 14 days of purchase. If a refund for the Premium access is requested after it has already been activated, access to the service is revoked.

3. HOW TO PURCHASE THE 12-MONTH PREMIUM ACCESS?

You can purchase 12-month Premium access on the Deeper Sonar website at: deepersonar.com. You will get a code, which you can either use yourself or use it as gift for your friends, relatives, or other acquaintances. 

Once you have purchased 12-month Premium access, the 12-month Premium access code will be electronically delivered to you or a designated recipient to the specified email address.  

4. HOW TO USE 12-MONTH PREMIUM ACCESS? 

You can only redeem the 12-month Premium access online on the Website for an annual subscription of Fish Deeper Premium.

When ordering Fish Deeper Premium please select ‘Redeem 12-Month Access’. Enter the 12-month Premium access code. Select the “Redeem” button to get the 12 months subscription of Fish Deeper Premium.

Keep the 12-month Premium access code safe. Once we electronically transmit 12-month Premium access code to you or designated recipient, whichever is applicable, the risk of loss and title for 12-month Premium access pass to you or designated recipient. We are not responsible if any 12-month Premium access codes are lost, stolen, destroyed, or used without your permission.

Fish Deeper Premium can be subscribed to and 12-month Premium access can be purchased in all of the countries where Deeper products are available, however Fish Deeper Premium can only be effectively used in the following countries: Australia, Austria, Belgium, Bulgaria, Canada, China, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Indonesia, Ireland, Italy, Japan, Lithuania, Latvia, Malaysia, Netherlands, Norway, Poland, Portugal, Romania, Singapore, Slovakia, South Korea, Spain, Sweden, Switzerland, Turkey, United Kingdom, Ukraine, United States of America. 

Fish Deeper Premium service covers more than 70 000 lakes, but there are still lakes that are not covered yet. Please check lake coverage on the Website at: https://maps.fishdeeper.com/en-ww. 

You may not apply 12-month Premium access towards charges for changes to existing subscriptions or Products or use it to purchase other 12-month Premium access codes. 12-month Premium access cannot be resold, transferred for value or redeemed for cash, except to the extent required by law. If the 12-month Premium access is applied on the effective subscription under your or other recipient’s account, the subscription within the 12-month Premium access will become effective once the existing subscription expires or is terminated.

5. FRAUD

We reserve the right to any remedy, including refusal to issue or honour the 12-month Premium access, in the event of suspected fraud. We will have the right to close the account and charge alternative payment methods if a fraudulently obtained 12-month Premium access is redeemed and/or used to make purchases on the account.

6. LIMITATION OF LIABILITY

In the event a 12-month Premium access is non-functional, your sole remedy, and our sole liability, will be the replacement of such 12-month Premium access.

We reserve the right to amend or supplement these 12-month Premium access terms and the 12-month Premium access at any time.

7. TERMINATION AND WAIVER

Your rights under a 12-month Premium access will terminate if you materially fail to comply with these 12-month Premium access terms or if your account with Deeper and/or Fish Deeper is terminated or is suspended. Upon termination, you must cease all use of the 12-month Premium access, and we may revoke your access to 12-month Premium access balance. Our failure to insist upon or enforce your strict compliance with these 12-month Premium access terms will not constitute a waiver of any of our rights.

8. YOUR PERSONAL DATA

We will process your data as stated in our Privacy Policy available at: https://deepersonar.com/uk/en_gb/privacy-policy

9. OTHER TERMS

We may modify these 12-month Premium access terms at any time. When we make material changes to these 12-month Premium access terms, we will post the revised 12-month Premium access terms on the Website. We will also provide you with notice of any material changes by email at least 30 days before the date they become effective, and will inform you about your right to terminate your account with Deeper. Unless you terminate your agreement with Deeper before the date the revised 12-month Premium access terms become effective, your continued access to or use of the Deeper account will constitute acceptance of the revised 12-month Premium access terms. All terms and conditions are applicable to the extent permitted by law.

Šios Fish Deeper Premium prieigos (12 mėn.) naudojimo sąlygos (toliau – 12 mėn. Premium prieigos sąlygos) reglamentuoja Fish Deeper Premium prieigos (12 mėn.) (toliau – 12 mėn. Premium prieiga) naudojimą Fish Deeper svetainėje adresu https://maps.fishdeeper.com (toliau – Svetainė). Be to, 12 mėn. Premium prieigos ir Fish Deeper paslaugų naudojimui Svetainėje taikomos DEEPER NUOSTATOS IR SĄLYGOS (toliau – Sąlygos), kurios pateiktos čia: https://deepersonar.com/lt/lt_lt/salygos-ir-nuostatos; jei šiose 12 mėn. Premium prieigos sąlygose kokia nors sąvoka yra neapibrėžta, ji reiškia tą patį, kaip ir Sąlygose apibrėžta atitinkama sąvoka. Šios 12 mėn. Premium prieigos sąlygos suprantamos ir aiškinamos atsižvelgiant į bendrąsias Sąlygas.

2. FISH DEEPER PREMIUM PRIEIGA (12MĖN.)

12 mėn. Premium prieiga yra skaitmenų sekos kodas, kurį galite įsigyti, perleisti arba padovanoti ir kurį prieigos kodo turėtojas (jūs arba asmuo, kuriam prieigos kodas buvo perleistas arba padovanotas) gali panaudoti. 

Norint gauti ir panaudoti 12 mėn. Premium prieigos kodą, reikia turėti Fish Deeper paskyrą.

12 mėn. Premium prieigos vertė lygi metinės Fish Deeper Depth Maps (Premium paslaugos) (toliau – Fish Deeper Premium) prenumeratos kainai ir už ją galite gauti tik metinę Fish Deeper Premium prenumeratą Svetainėje. 

12 mėn. Premium prieiga galioja 12 mėnesių nuo įsigijimo datos. Pasibaigus galiojimo datai 12 mėn. Premium prieigos nebegalėsite panaudoti.

Pinigai už 12 mėn. Premium prieigą gali būti grąžinami per 14 dienų nuo įsigijimo. Tokiu atveju, kai paslauga jau aktyvuota, paslauga taip pat nustoja galioti.

3. KAIP ĮSIGYTI 12MĖN. PREMIUM PRIEIGĄ?

12 mėn. Premium prieigą galima įsigyti Deeper Sonar svetainėje adresu deepersonar.com. Gausite kodą, kurį galite panaudoti patys arba padovanoti draugui, giminaičiui ar kitam asmeniui. 

Kai 12 mėn. Premium prieiga įsigyjama, 12 mėn. Premium prieigos kodas išsiunčiamas jums arba numatytam gavėjui nurodytu el. pašto adresu.  

4. KAIP PANAUDOTI 12 MĖN.PREMIUM PRIEIGOS KODĄ? 

Panaudoti 12 mėn. Premium prieigos kodą galite tik internetu Svetainėje metinei Fish Deeper Premium prenumeratai gauti.

Užsisakydami Fish Deeper Premium pasirinkite „Panaudoti Premium prieigos kodą“. Įveskite 12 mėn. Premium prieigos kodą. Spustelėkite mygtuką „Panaudoti“ ir gaukite 12 mėnesių Fish Deeper Premium prenumeratą. 

Laikykite 12 mėn. Premium prieigos kodą saugiai. Kai elektroniniu būdu perduodame kodą jums arba numatytam gavėjui (priklausomai nuo to, kas taikytina), praradimo rizika ir nuosavybės teisė į 12 mėn. Premium prieigą atitenka jums arba numatytam gavėjui. Neprisiimame atsakomybės už 12 mėn. Premium prieigos kodo praradimą, vagystę arba naudojimą be jūsų leidimo.

Užsiprenumeruoti Fish Deeper Premium ir įsigyti 12 mėn. Premium prieigą galima visose šalyse, kuriose parduodami Deeper produktai, tačiau Fish Deeper Premium efektyviai veikia tik šiose šalyse: Australijoje, Austrijoje, Belgijoje, Bulgarijoje, Kanadoje, Kinijoje, Kroatijoje, Čekijos Respublikoje, Danijoje, Estijoje, Suomijoje, Prancūzijoje, Vokietijoje, Graikijoje, Vengrijoje, Indonezijoje, Airijoje, Italijoje, Japonijoje, Lietuvoje, Latvijoje, Malaizijoje, Nyderlanduose, Norvegijoje, Lenkijoje, Portugalijoje, Rumunijoje, Singapūre, Slovakijoje, Pietų Korėjoje, Ispanijoje, Švedijoje, Šveicarijoje, Turkijoje, Jungtinėje Karalystėje, Ukrainoje, Jungtinėse Amerikos Valstijose.

12 mėn. Premium prieigos kodo negalima naudoti esamoms prenumeratoms ar Produktams apmokėti arba kitiems 12 mėn. Premium prieigos kodams įsigyti. 12 mėn. Premium prieigos kodų negalima perparduoti, perduoti atlygintinai arba iškeisti į piniginę sumą, išskyrus įstatymų numatytus atvejus. Jei 12 mėn. Premium prieigos kodas panaudojamas esant kitai galiojančiai prenumeratai jūsų arba kito gavėjo paskyroje, 12 mėn. Premium prieigos suteikiama prenumerata pradės galioti, kai baigsis arba bus nutraukta esama prenumerata.

5. SUKČIAVIMAS

Įtariamo sukčiavimo atveju galime taikyti bet kokią teisių gynimo priemonę, įskaitant atsisakymą išduoti ar priskirti 12 mėn. Premium prieigą. Jei sukčiavimo būdu pasisavintas 12 mėn. Premium prieigos kodas panaudojamas, turime teisę užblokuoti paskyrą ir pritaikyti mokestį kitais mokėjimo metodais.

6. ATSAKOMYBĖS RIBOJIMAS

Jei 12 mėn. Premium prieigos kodas neveikia, jūsų vienintelė teisė yra reikalauti, o mūsų vienintelis įsipareigojimas yra užtikrinti, kad toks kodas būtų pakeistas.

Turime teisę bet kuriuo metu keisti ar pildyti šias 12 mėn. Premium prieigos sąlygas ir pačią 12 mėn. Premium prieigą.

7. TEISIŲ NUTRAUKIMAS IR ATSISAKYMAS

Jūsų kaip 12 mėn. Premium prieigos turėtojo teisės nustoja galioti, jei iš esmės pažeidžiate šias 12 mėn. Premium prieigos sąlygas arba jei jūsų Deeper ir (arba) Fish Deeper paskyra yra panaikinama arba sustabdoma. Teisėms nutrūkus turite nustoti naudoti 12 mėn. Premium prieigą ir galime atšaukti jūsų likusią prieigą prie Fish Deeper Premium. Faktas, kad nesiimame griežtų priemonių jūsų atžvilgiu dėl šių 12 mėn. Premium prieigos sąlygų laikymosi, nereiškia, kad atsisakome kokių nors savo teisių.

8. JŪSŲ ASMENS DUOMENYS

9. KITOS SĄLYGOS

Bet kada galime keisti šias 12 mėn. Premium prieigos sąlygas. Atlikę esminius pakeitimus šiose 12 mėn. Premium prieigos sąlygose, paskelbsime atnaujintas 12 mėn. Premium prieigos sąlygas Svetainėje. Taip pat pranešime apie bet kokius esminius pakeitimus el. paštu likus mažiausiai 30 iki jų įsigaliojimo datos ir informuosime apie jūsų teisę panaikinti savo Deeper paskyrą. Jei nenutrauksite sutarties su Deeper prieš įsigaliojant atnaujintoms 12 mėn. Premium prieigos sąlygoms, tolesnė jūsų prieiga ir naudojimasis Deeper paskyra reikš, kad sutinkate su atnaujintomis 12 mėn. Premium prieigos sąlygomis. Visos sąlygos ir nuostatos taikomos pagal įstatymų numatytą apimtį.
