TERMS & CONDITIONS
REWARD FOR SCANS PROGRAMME
1. INTRODUCTION
We are Deeper, UAB (“Deeper” or “we”), legal entity code 302749154, address Antakalnio g. 17, LT-10312 Vilnius, Lithuania. We are happy that you are using Deeper products and we want to offer you the Reward for Scans programme! Below we provide these terms and conditions (“Rules”) for this programme.
It’s important that you know what you can expect from this programme if you choose to take part in it. And in case you have something more exciting to read than this, you can always come back and review these Rules again whenever you need to.
2. WHO CAN PARTICIPATE
Any Fish Deeper mobile app (“App”) user can participate in this programme.
Once you start participating in this programme, these Rules apply to you.
3. HOW IT WORKS
You will get points for your every uploaded eligible fishing session (scan)* and only for complete uploads. Non-uploaded fishing sessions, i.e., those stored on your phone, are not counted towards reward points.
*Eligible fishing sessions are generated with scans done with:
CHIRP+ 2, CHIRP+, PRO+ 2, PRO+ (Boat, Onshore and Ice Fishing modes).
CHIRP 2, CHIRP and PRO (Boat and Ice Fishing modes).
1000 points = 1 free month. To earn 1000 points, you'll need to scan 25 hectares per month. After earning 1000 points, you can redeem them on the App and get 1 month of free Fish Deeper Premium (depth maps). You can accumulate more points to get several months.
Maximum of 1000 points can be earned per calendar month (12000 per 12 months). There are no limitations to the time in which they can be activated unless we specify otherwise later.
Please note it is only possible to redeem all the free months of Fish Deeper Premium (depth maps) at the same time (e. g. if you have 2000 points you can only redeem 2 months). It is not possible to split points and use 1 of the 2 free months you have at that moment and get only 1 month of free Fish Deeper Premium (depth maps).
Once you’ve redeemed:
· If you don’t have a Premium subscription, you can redeem free Premium immediately.
· If you already have a Premium subscription, you can still redeem free months anytime, but redeemed months start only after you cancel your paid subscription and it expires.
· If you have redeemed Premium for Deeper Sonar (for 3 free months) you can still redeem free months anytime and they will be added in a row.
For the time being, the number of points currently accumulated can only be seen on the App in a dedicated subsection (choosing “Premium” on the Main menu of the App).
The App does not show how many hectares you have scanned. We use complex, constantly updated algorithms created by us to translate scanned data into meaningful outcomes, like hectares. Therefore, the outcome might differ using other algorithms or means of calculating. The number of points collected and the area scanned is decided by Deeper, and we confirm that points are calculated fairly and responsibly.
Displaying the newly collected points usually takes up to 10 minutes depending on the length of the fishing session but can take up to 1 hour depending on circumstances (internet connection, device, etc.).
4. YOUR PERSONAL DATA
To automatically allocate the points that belong to you, we will internally process your account data details only with your explicit consent! That includes your name, surname, e-mail address, country of residence, city, address, location (GPS coordinates), Deeper data generated by sonar (typing, usage patterns and other metadata), sonar usage history, type of your computer/mobile device, unique mobile device ID, IP address, mobile operating system and version, mobile browsers, preferred language and preferences while using the App and earned points.
Legal basis for such processing – your freely given consent and Deeper’s legitimate interest.
All data processed for the programme will be stored for 5 (five) years from the end of this programme.
5. YOUR RIGHTS
Remember that you ALWAYS have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
Also, you have:
· The right to be informed.
· The right to access the information related to your personal data.
· The right to rectification of your personal data, the right to be forgotten.
· The right to restrict the processing of your personal data.
· The right to object to the processing of your personal data.
· The right to data portability.
There are some limitations and preconditions provided by law. If this is the case, we will make a reasoned statement regarding this situation.
However, we seek to solve every situation peacefully, so we kindly ask you to contact us first. If our answer disappoints you, you have the right to lodge a complaint with a supervisory authority (The Lithuanian supervisory authority is the State Data Protection Inspectorate, for more information and contacts, see the Inspectorate's website https://vdai.lrv.lt/).
We will not share your data with any other entity. We will use data gathered by you only for internal analytical purposes.
6. HOW TO EXERCISE YOUR RIGHTS
Contact us via e-mail at support@deeper.eu to let us know you wish to exercise any of your rights.
Your rights implementing appropriate actions will be carried out by Deeper as soon as possible, but no later than within 1 (one) month from the date of your referral.
7. PROGRAMME ELIGIBILITY, MODIFICATION & DURATION
These Rules will enter into force on 2021 12 16. We reserve the right to modify these Rules (its conditions, the amount of the awards, etc.) by announcing these modifications in advance in the same manner as these Rules were announced. The programme will be eligible until we announce otherwise.
8. UNREDEEMED POINTS & FAIR PARTICIPATION
Please note, points are not converted into cash. If you don't redeem points, they will be annulled after the end of this programme.
We want the programme to be fair to all participants, so in the event of a participant's failure to comply with the Rules or in cases of cheating, we may restrict or suspend the participant's partaking in the programme.
