Welcome to the Deeper Pre-order Program ("Program"), brought to you by UAB Deeper ("Deeper"). This Program allows customers to place a pre-order for the Deeper Spark Baitboat – an advanced watercraft designed for fishing enthusiasts, incorporating cutting-edge technology to enhance your fishing experience ("Product"), under specific terms and conditions set forth herein.

PLEASE READ THESE PRE-ORDER TERMS CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS, WHICH ALSO INCORPORATE THE TERMS AND CONDITIONS, AND PRIVACY POLICY AVAILABLE ON OUR WEBSITE (COLLECTIVELY, " PRE-ORDER TERMS"). IF YOU DO NOT AGREE TO THESE PRE-ORDER TERMS, DO NOT ACCESS OR PARTICIPATE IN THE PROGRAM. THESE PRE-ORDER TERMS ARE ENTERED INTO BETWEEN YOU AND DEEPER.

By making your pre-order, you understand and agree to the following:

1. By participating in this Program you are agreeing to these Pre-order Terms and confirm that you have, in addition, read and understood Deeper Privacy Policy and Terms and Conditions. In the event of any conflict between the Terms and Conditions and these Pre-Order Terms, the Pre-Order Terms shall prevail.

2. The Program offers you the opportunity to place a pre-order for the Product under the terms set out herein. By participating in the Program, you make a Pre-order Payment as an advance toward the total purchase price and provide your payment details for the purpose of completing the purchase at a later stage. While the Program reflects your intention to purchase the Product, you retain the right to cancel your pre-order and receive a full refund of the Pre-order Payment at any time prior to the charge of the remaining balance.

3. Your participation in the Program is confirmed by paying a pre-order payment of €300 or the equivalent amount in another currency (the “Pre-order Payment”), as determined at the time of payment, which constitutes a partial advance payment toward the total price of the Product.

By completing your pre-order and providing your payment details at checkout, you agree that:

• the Pre-order Payment will be charged immediately; and 
• the remaining balance may be charged later in single additional payment, using the same payment method, before the Product is shipped. 

The remaining balance will only be charged when the Product is ready for shipment or shortly before shipment. You will be notified in advance and may cancel your pre-order at any time before the final charge and receive a full refund of the Pre-order Payment.

4. Each customer is allowed to reserve a maximum of two Products.

5. Your pre-order will remain valid until either:

• the remaining balance is charged in accordance with these Terms; 
• you cancel your pre-order prior to such charge; or 
• Deeper cancels your pre-order in accordance with these Terms.

6. You have the right to cancel your pre-order by providing written notice via the website or by contacting support (support@deeper.eu) at any time prior to the charge of the remaining balance, and a full refund of the Pre-order Payment will be provided within 60 days after receiving the notice.

7. Likewise Deeper has the right to cancel your preporders at any time, and a full refund of the Pre-order Payment will then be provided to you within the term of 60 days after receiving the respective notice by Deeper.

8. Payments are processed by Shopify Payments. Deeper does not store full payment card details and only receives limited payment-related information (such as payment status and partial card identifiers). Payment details are securely handled and stored by Shopify Payments in accordance with its own terms and privacy policy. By participating in the Program, you acknowledge and agree to the use of such payment service providers.

9. Deeper will notify you by email prior to charging the remaining balance of your pre-order. The notification will include the amount to be charged and instructions on how to cancel your pre-order before the charge is executed.

10. We do not guarantee specific dates of Product manufacture. Production and delivery timelines may vary, and any provided dates, even if communicated by Deeper, are only the approximate estimates. The timing of the charge of the remaining balance will be aligned with the expected shipment timing.

11. When the Product becomes available for shipment, Deeper will notify you in advance and will initiate the charge of the remaining balance of the purchase price using the payment method provided at checkout. You may cancel your pre-order prior to such charge within the period specified in the notification. 

Please note that you would only be able to purchase the pre-ordered Product(s) in our official store at deepersonar.com, and the pre-orders would not be enforceable at any other locations and sale points.

12. Deeper will not pay any interest on the Pre-order Payment(s), regardless of whether the Pre-order Payment(s) are applied to the purchase of the Product(s), or if the Pre-order Payment(s) is(are) returned to you after you or Deeper cancels your pre-order(s). 

13. Your pre-order(s) is not transferable or assignable to any other person.

14. If you cancel your pre-order prior to the charge of the remaining balance, the Pre-order Payment will be fully refunded. If the Product is purchased and subsequently returned in accordance with applicable return policies, the Pre-order Payment will be treated as part of the purchase price and refunded accordingly, unless otherwise specified in applicable return terms.

15. Deeper may ask you to provide further information it deems necessary to secure your pre-order(s), which you agree to supply in a reasonably timely manner. Deeper will maintain your personal information in accordance with its Privacy Policy.

16. Deeper is not responsible for any pre-order made by third parties regarding the production, delivery date, price, specifications, or any other information about the Product(s). Any information not officially communicated by Deeper should be treated with caution.

17. Deeper reserves the right to update, modify, or change these Pre-order Terms at any time upon reasonable notice to you. Upon notice, if you do not object within 20 days and you continue to maintain your pre-order, you agree to be bound by the modified Pre-Order Terms.

18. These Pre-Order Terms are governed by Lithuanian law. Any dispute arising out of or in connection with these terms falls within the jurisdiction of Lithuanian courts. Additionally, in accordance with EU law, we acknowledge the right to consumer dispute resolution. A customer who is deemed to be a consumer may also resolve disputes with Deeper electronically without recourse to the courts. In the first place, such customer must contact Deeper in writing by e-mail and within 14 (fourteen) days from the receipt of the claim, if Deeper does not respond to the customer’s claim or does not satisfy the customer’s claim, the customer may submit the request and/or complaint to the State Consumer Rights Protection Inspectorate (Vilniaus str. 25, 01402 Vilnius, Lithuania, e-mail tarnyba@vvtat.lt, the website www.vvtat.lt, to its territorial units in the districts) or by filling in the application form on the Electronic Consumer Dispute Resolution Platform available at http://ec.europa.eu/odr/. This clause does not apply to customers who are not considered consumers.
